Hereinafter referred to as "Olimpia 1960" or "Seller".

2. DEFINITIONS

For the purposes of these General Terms and Conditions of Sale, the following terms shall have the meaning indicated below:

"Customer" or "Consumer": the natural person acting for purposes unrelated to any entrepreneurial, commercial, craft or professional activity, who makes purchases on the Site.

"Products": the movable goods offered for sale on the Site, consisting of men's and women's underwear produced by Olimpia 1960.

"Order": the contractual proposal for the purchase of Products sent by the Customer through the Site.

"Contract": the contract for the sale and purchase of Products concluded between the Seller and the Customer.

3. SCOPE OF APPLICATION

These General Terms and Conditions of Sale govern the offer and sale of Products on the Site and apply to all purchases made on the Site by Customers.

These Conditions are drawn up in accordance with Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 (Electronic Commerce), as well as European consumer protection regulations.

Before proceeding with the purchase, the Customer is required to carefully read these General Terms and Conditions of Sale. Sending the Order implies full knowledge and acceptance thereof.

4. PRODUCTS AND INFORMATION

The Products offered on the Site are described in their respective product sheets containing the main characteristics, including composition, available sizes, colors and, where applicable, care instructions.

The images of the Products on the Site are representative and may not perfectly correspond to the actual Products due to the settings of the devices used for viewing. Any differences in color or shade do not constitute a defect in the Product.

Olimpia 1960 reserves the right to modify, at any time and without prior notice, the characteristics of the Products in order to improve their quality.

5. PRODUCT CUSTOMIZATION (EMBROIDERY)

Some Products can be customized with embroidery at the Customer's request. Customization includes the insertion of a short text (maximum 3 characters) and the choice of thread color from a predefined palette.

The Customer is responsible for the correctness of the text entered. Olimpia 1960 is not responsible for typing errors or inappropriate content entered by the Customer.

IMPORTANT: Personalized Products with embroidery cannot be returned or replaced, unless they have defects of conformity, pursuant to Article 59, paragraph 1, letter c) of the Consumer Code.

6. PURCHASE PROCEDURE

To make a purchase, the Customer must select the desired Products, indicating size, color and, where applicable, personalization options.

The Order is sent by clicking the "Confirm order" button after completing the checkout procedure, entering billing details, shipping address, and selecting the payment method.

Sending the Order constitutes the Customer's contractual proposal and implies full knowledge and acceptance of these General Terms and Conditions of Sale.

Olimpia 1960 will send the Customer an Order confirmation email containing a summary of the purchase information. This email does not constitute acceptance of the Order.

The Contract is concluded when Olimpia 1960 sends the Customer an email confirming the shipment of the Products or, in any case, when the Products are delivered to the carrier.

7. PRICES

All Product prices indicated on the Site are expressed in Euro and include VAT.

Shipping costs are not included in the Product price and are indicated separately during the checkout process, before Order confirmation.

Olimpia 1960 reserves the right to modify prices at any time, it being understood that the price applied to the Order will be that indicated on the Site at the time the Order is sent by the Customer.

8. PAYMENT METHODS

Payment for the Products can be made using the following methods:

Credit/debit cards: Visa, Mastercard, American Express and other accepted circuits. Card data is handled directly by the payment provider and is not stored by Olimpia 1960.

PayPal: the Customer will be redirected to the secure PayPal site to complete the payment.

Bank transfer: bank details will be communicated at the time of the Order. Shipment will only take place after the amount has been credited.

9. SHIPPING AND DELIVERY

Products are shipped to the address indicated by the Customer during the checkout process.

Delivery times: delivery generally takes place within 5 working days from order confirmation for shipments in Italy. For islands and remote areas, times may be longer. For international shipments, times vary depending on the destination.

Shipping costs: Free for orders over €90, otherwise €6.90

At the time of shipment, the Customer will receive a confirmation email with the tracking code to monitor the delivery status.

Upon delivery, the Customer is required to verify the integrity of the package and, in case of anomalies, to make a written reservation on the courier's delivery document.

10. RIGHT OF WITHDRAWAL

Pursuant to Articles 52 et seq. of Legislative Decree 206/2005 (Consumer Code), the consumer Customer has the right to withdraw from the Contract without giving any reason within 14 (fourteen) days.

The withdrawal period expires after 14 days from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires physical possession of the Products.

10.1 How to exercise the right of withdrawal

To exercise the right of withdrawal, the Customer must inform Olimpia 1960 of their decision by means of an explicit statement (e.g. letter sent by post, email or via the contact form on the Site).

The Customer may use the attached standard withdrawal form, but this is not mandatory.

10.2 Effects of withdrawal

In case of withdrawal, Olimpia 1960 will refund all payments received from the Customer, possibly including standard delivery costs, without undue delay and in any case no later than 14 days from the day on which Olimpia 1960 was informed of the Customer's decision to withdraw.

The refund will be made using the same means of payment used for the initial transaction, unless otherwise agreed. The refund may be suspended until receipt of the Products or until the Customer demonstrates that they have returned the Products.

10.3 Return of Products

The Customer must return the Products without undue delay and in any case within 14 days from the day on which they communicated the withdrawal. The deadline is met if the Customer returns the Products before the expiry of the 14-day period.

The direct costs of returning the Products are borne by the Customer.

10.4 Conditions of returned Products

Products must be returned intact, unused, with all original labels still attached and in their original packaging. Being intimate apparel items, for hygiene reasons, Products must not have been worn (except over one's own underwear for fitting) and must be returned in their original condition.

The Customer is responsible for any diminished value of the Products resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the Products.

10.5 Exclusions from the right of withdrawal

Pursuant to Article 59 of the Consumer Code, the right of withdrawal is excluded for: Products made to measure or clearly personalized (including embroidered products); sealed Products that are not suitable for return for hygienic reasons or health protection and have been opened after delivery.

11. LEGAL WARRANTY OF CONFORMITY

All Products sold on the Site are covered by the legal warranty of conformity provided for by Articles 128-135 of the Consumer Code.

The legal warranty has a duration of 2 (two) years from the delivery of the Product and covers defects of conformity existing at the time of delivery.

In case of a defect of conformity, the Customer has the right to have the Product restored to conformity by repair or replacement, or, if this is not possible, to a proportional reduction in price or termination of the Contract.

To claim the warranty, the Customer must contact Olimpia 1960 providing proof of purchase (receipt, order confirmation, bank statement).

13. ALTERNATIVE DISPUTE RESOLUTION (ADR/ODR)

Pursuant to Article 141-sexies, paragraph 3, of the Consumer Code, Olimpia 1960 informs the consumer Customer that, in the event of a dispute, they may submit a complaint through the ODR (Online Dispute Resolution) platform established by the European Commission.

14. PRIVACY AND PROCESSING OF PERSONAL DATA

Customer's personal data is processed in accordance with EU Regulation 2016/679 (GDPR) and Italian legislation on personal data protection. For complete information on the processing of personal data, please consult the Privacy Policy available on the Site.

15. INTELLECTUAL PROPERTY

All content on the Site (texts, images, logos, graphics, software) is the exclusive property of Olimpia 1960 or its licensors and is protected by copyright and intellectual property laws. Any unauthorized reproduction, distribution or use is prohibited.

16. LIMITATION OF LIABILITY

Olimpia 1960 shall not be liable for indirect, incidental or consequential damages arising from the use of the Site or the Products, to the extent permitted by applicable law. Olimpia 1960 is not responsible for any disservices or malfunctions of the Site due to force majeure or circumstances beyond its reasonable control.

17. CHANGES TO THE GENERAL CONDITIONS

Olimpia 1960 reserves the right to modify these General Terms and Conditions of Sale at any time. The changes will be effective from the date of publication on the Site. For Orders already placed, the Conditions in force at the time of sending the Order apply.

18. APPLICABLE LAW AND JURISDICTION

These General Terms and Conditions of Sale are governed by Italian law.

For any dispute relating to the interpretation, execution or termination of these Conditions or individual Orders, the Court of the Consumer's place of residence or domicile, if located in Italian territory, shall have exclusive jurisdiction.
